Terms and Conditions.

1) CONTRACT REGULATIONS

The present General Conditions of Sale regulate the Sales Contract between WineExperience.Style and the Purchaser.  Variations of the present General Conditions of Sale are not valid unless accepted by WineExperience.Style in writing.

2) PURCHASE AUTHORISATION

The products bought by the Purchaser are for professional or personal use or as a gift and must not be resold, used for commercial purposes or for any other commercial benefits. The purchase for commercial use is permitted only if the Purchaser and WineExperience.Style have entered into a distribution contract together.

3) CHARACTERISTICS OF THE PRODUCTS

The main characteristics of the products are present on the site www.wineexperience.style or in the documents provided in digital pdf format.

4) PRICES

The total price of the purchase complete of delivery is expressed in euro inside the page Cart. If the shipping address is outside the European territory, will be examined, during the processing of the order confirmation, if there are any import duties as well as VAT of the corresponding countries or any tax charges.

5) CONFIRMATION OF ORDER

The order request is made through the electronic form Checkout present on the site WineExperience.Style. At the time of the order request, the Buyer will have to provide to WineExperience.Style the data relating to the person or fiscal data relating to the company to allow the sending of the order confirmation. Once the payment is made at the Checkout page, an email is sent that the order request has been successfully completed. The order confirmation is sent later after WineExperience.Style has reviewed and accepted the request. We may contact you for the following reasons:
– the goods are not available;
– the quantity of products is too high for delivery in a few days;
– asking for explanations if the order request contains incorrect information or addresses not recognized by the shipping system.
In case WineExperience.Style should contact the Buyer and does not receive any answer within 7 days, the order will be cancelled.

6) PAYMENT METHODS

The price and method of payment for the purchase of Products are indicated on the Checkout page of the site www.wineexperience.style.

7) DELIVERY

7.1) The date of delivery, the method of shipment of the Products are all indicated in the order confirmation. The Products shall be delivered to the address indicated by the Purchaser by the carrier responsible for transport in the manner and within the period indicated in the order confirmation and in any event not later than 30 days unless the parties have agreed otherwise.
7.2) WineExperience.Style cannot be held responsible for delivery failures due to inaccuracies or incompleteness in the compilation of the order by the Purchaser.
7.3) WineExperience.Style can also not be held responsible for any damage that may occur to the Products after delivery to the carrier responsible for their transport as well as for delays in delivery attributable to the latter.
7.4) If it is not possible to supply the Products requested, the Purchaser will be notified promptly by email, stating when delivery is expected or the reasons why delivery is impossible. If the Purchaser does not intend to accept the new deadline or delivery has become impossible, he may terminate the sale contract and ask for a refund of the amount paid, which will be credited promptly in the same mode of payment used by the Purchaser for the purchase within 14 days from the date on which WineExperience.Style became aware of the request for reimbursement.
7.5) In the event of a delay in the delivery of the Products of more than 30 days, the Purchaser has the right to terminate these General Conditions if WineExperience.Style has not respected the additional delivery period agreed between the parties.
7.6) Upon receiving the goods, the Purchaser is required to verify and check conformity with the order. Only after such a check should the Purchaser proceed with the signing of the transport documents.
7.7) WineExperience.Style declines any responsibility for delays or lack of delivery caused by extenuating circumstances such as accidents, explosions, fire, strikes and/or lockouts, earthquakes, floods or other similar events which prevent, all or in part, the delivery from taking place in the time limits established.

8) GUARANTEE OF COMPLIANCE

All products that are included in the category of “consumer goods”, in accordance with article 128, paragraph 2 of the Consumer Code, are covered by the legal guarantee of conformity imposed by articles 128-135 of the Consumer Code. The legal guarantee of conformity is reserved to purchasing consumers, that is to say those who have made a purchase for purposes unrelated to any potential business, commercial, artisanal or professional activity carried out. Any fault or defect of conformity which manifests within 24 months of delivery must be reported within 2 months following the date when the defect was discovered. Unless proved otherwise, it is presumed that any defect of conformity which arises within 6 months of the delivery of the Product already existed at that date, unless this hypothesis is incompatible with the nature of the Product or with the nature of the defect of conformity. After 6 months, it is the Purchaser who must provide evidence that the damage did not originate from incorrect or improper use of the Product. In accordance with art. 130 of the Consumer Code, in event of a defect of conformity of the products, the Purchaser has the right to restoration of conformity of the products without any expenses. To this effect, the Purchaser can choose between reparation or replacement of the product. If the Purchaser intends to make use of the solution provided by the legal guarantee which accompanies the product, notification should be sent to WineExperience.Style. WineExperience.Style will reply promptly to the communication of the presumed defect of conformity and specify to the Purchaser the specific procedure to follow, taking into account the product category to which the product belongs and/or the defect reported.

9) WITHDRAWAL RIGHTS

9.1) The right of withdrawal, provided for in the distance selling regulations, allows the consumer Purchaser who purchases Products for purposes not related to his professional, commercial or entrepreneurial activity to return the purchased Product and obtain reimbursement of the expense incurred without any penalty and without indicating the reason.
9.2) In order to exercise the right of withdrawal, it is necessary within 14 calendar days of receipt of the products to communicate the wish to withdraw from the contract by email to info@wineexperience.style, indicating the purchase invoice number.
9.3) Essential condition for the exercise of the right of withdrawal will be the substantial integrity of the products to be returned. The products must be returned intact, in particular:
 – packaged in their original packaging and with all accessories and documentation;
 – without being ruined, damaged, soiled or bear traces of use other than those necessary to verify the aesthetic satisfaction of purchase.
9.4) After WineExperience.Style has received the return and checked that all the requirements at points 9.2 and 9.3 have been respected, it will send an email to the Purchaser confirming acceptance of the return. The refund will be made as soon as possible and in any case within 14 days of receipt of the return. It is not possible to change the model of the Product on which the right of withdrawal is claimed with another one.
9.5) The costs of returning the Product shall be covered by the Purchaser. The right to withdraw cannot be exercised for tailor-made Products or Products clearly customized for the Purchaser.

10) INTELLECTUAL PROPERTY RIGHTS

All contents, including commercial brands, designs and the graphics mentioned or shown on the WineExperience.Style site or in pdf documents of the Product presentations are all protected by national intellectual property and other laws and international treaty provisions. Any reproduction or redistribution of the above listed contents is prohibited and could result in sanctions in accordance with civil and penal law.

11) EXPRESS TERMINATION CLAUSE

In the cases indicated in Articles 7.4) and 7.5), the Purchaser has the right to terminate this Contract, pursuant to Article 1456 of the Italian Civil Code, by sending an email to info@wineexperience.style.

12) APPLICABLE LAW AND PLACE OF JURISDICTION

The Conditions are subject to Italian law. For the Consumer Users any dispute relating to the application, execution and interpretation of the present Conditions shall be devolved to the court of the place in which the Consumer User resides or has elected domicile, if located in the territory of the Italian State, without prejudice to the right of the Consumer User to refer to a judge other than the “consumer court” pursuant to art. 66 bis of the Consumer Code, competent for the territory according to one of the criteria set forth in articles 18, 19 and 20 of the civil procedure code. This is without prejudice to the application to Consumer Users who do not have their habitual residence in Italy of the provisions which may be more favourable and mandatory provided for by the law of the country in which they have their habitual residence, in particular in relation to the term for the exercise of the right of withdrawal, the term for the return of the Products, in the event of the exercise of such right, the procedures and formalities for the communication of the same and the legal guarantee of conformity. For non-Consumer Users, any dispute relating to the application, execution and interpretation of these Conditions shall be referred to the courts of the place where the Owner is established.

13) DISPUTE RESOLUTION FOR CONSUMER USERS

The Consumer User residing in Europe should be aware that the European Commission has set up an online platform that provides an alternative dispute resolution tool. This tool can be used by the User Consumer to resolve in a non-judicial way any dispute relating to and/or arising from contracts for the sale of goods and supply of services stipulated on the Internet. Consequently, the User Consumer may use this platform for the resolution of any dispute arising from the contract concluded online. The platform is available at the following address: ec.europa.eu/consumers/odr/.
